Terms of Service
These terms are the agreement between you and Kowski Labs for the use of CarBluff. They are written to be read, not buried. The short version: CarBluff is an informational tool that helps you spot red flags in a used-car listing, it is not a guarantee, and the sections below spell out exactly what you can and cannot rely on it for.
1. Acceptance of these terms
By visiting carbluff.com, running a scan, or subscribing to a paid plan, you agree to these Terms of Service and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use CarBluff. If you are using CarBluff on behalf of a business, you confirm you have the authority to accept these terms for it. You must be at least 18 years old, or the age of majority where you live, to subscribe to a paid plan.
2. What CarBluff is (and is not)
CarBluff is an informational used-car-scam checker. You paste a listing link or the ad text, and the tool reads it, checks for common fraud patterns (things like payment red flags, suspicious links, "shipping company" stories, and below-market pricing), and returns a 0 to 100 trust score with the flags it found explained. Some plans add an optional Deal Score price comparison.
CarBluff is a decision aid, not a guarantee, verification service, or professional advice. A high score does not mean a listing is safe, legitimate, or that a car exists, runs, or is as described; a low score does not mean a seller is a criminal. The score is an automated estimate based on the text you provide and public data. It is not legal, financial, mechanical, or investment advice, and it is not a substitute for your own due diligence: meeting in a safe place, inspecting the vehicle, running a title and VIN history check, verifying the seller, and using a secure payment method. Every decision to contact a seller, send money, or buy a car is yours, and you are solely responsible for it.
3. Free scan and subscriptions
CarBluff offers a free scan so you can try the tool, and one or more paid plans that unlock additional scans and features. The current plans, prices, and what each includes are shown on our pricing page, which is part of these terms. We may change the features or limits of a plan over time; if a change is material and negative to an active subscription, we will make reasonable effort to notify you.
4. Billing, renewal, and cancellation
Paid subscriptions purchased on the website are processed by Stripe. We never see or store your card number. By subscribing, you authorize us, through Stripe, to charge your payment method the price shown at checkout, plus any applicable taxes, on a recurring basis.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period (for example, monthly or annually, as selected at checkout) at the then-current price for your plan, until you cancel. This is so your access does not lapse.
- Cancel anytime. You can cancel whenever you like through Stripe's customer portal (the "Manage" or "Restore plan" path from the site) or by emailing [email protected]. When you cancel, your plan stays active through the end of the period you have already paid for, and it does not renew after that.
- Refunds. Payments are generally non-refundable, and canceling stops future charges rather than refunding the current period. Because a free scan lets you try CarBluff before paying, we do not offer refunds for partially used or unused billing periods, except where a refund is required by law. If you believe you were charged in error, contact [email protected] and we will look into it in good faith.
- Price changes. If we change subscription pricing, the new price applies to your next renewal, not the period you are already in, and we will give reasonable notice before it takes effect. Continuing your subscription after that is your acceptance of the new price.
- App stores. If you subscribe inside the CarBluff mobile app, billing, renewal, and cancellation are handled by Apple's App Store or Google Play under their terms, and you manage or cancel that subscription in your App Store or Play Store account settings.
5. Acceptable use
CarBluff is for your own lawful, personal or internal business use in evaluating used-car listings. You agree not to:
- resell, sublicense, or redistribute access to CarBluff, or share paid access beyond what your plan allows;
- scrape, crawl, or use bots to pull data from CarBluff, or otherwise access it other than through the interface we provide;
- copy, frame, or republish our scoring output, checks, or content as if it were your own service;
- attempt to reverse engineer, probe, overload, or interfere with the site, its servers, or the scoring engine, or bypass any usage limit, paywall, or security measure;
- use CarBluff to break the law, harass anyone, or to facilitate fraud rather than avoid it;
- submit content you have no right to submit, or that contains malware.
We may suspend or terminate access that violates these terms or that we reasonably believe is abusive, fraudulent, or a risk to CarBluff or other users.
6. Intellectual property
CarBluff, including its name, logo, scoring methodology, checks, copy, and design, is owned by Kowski Labs and protected by intellectual property laws. These terms do not transfer any ownership to you; they grant you a limited, personal, non-transferable, revocable license to use CarBluff as intended while these terms are in effect. Any feedback you send us, we may use without obligation to you.
7. No warranty
CarBluff is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the tool will be uninterrupted, error-free, or secure, that any score or flag is accurate or complete, that any listing you scan is safe or unsafe, or that fetching a third-party listing will always succeed. Scam patterns change constantly, and no automated check can catch every fraud or clear every honest seller. You use CarBluff at your own risk.
8. Limitation of liability
To the fullest extent permitted by law, Kowski Labs and CarBluff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, vehicles, data, profits, or goodwill, arising out of or related to your use of (or inability to use) CarBluff, or any decision you make based on a score, flag, or other output, even if we have been advised of the possibility. In particular, and without limiting the point, we are not responsible for any transaction between you and a seller or buyer, or for any money you send, car you buy, or loss you suffer. Our total liability for any claim relating to CarBluff will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars (US$50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnity
You agree to indemnify and hold harmless Kowski Labs from any claims, damages, or costs (including reasonable legal fees) arising out of your misuse of CarBluff, your violation of these terms, or your violation of any law or the rights of a third party.
10. Third-party sites and services
CarBluff reads and links to listings and content on third-party marketplaces and uses third-party providers (such as Stripe for payments and mapping or pricing data sources). We do not control those sites or services and are not responsible for their content, accuracy, availability, or practices. Your dealings with them are between you and them.
11. Changes to these terms
We may update these terms from time to time. When we do, we will change the effective date at the top of this page, and for material changes we will make reasonable effort to give notice. Continuing to use CarBluff after an update means you accept the revised terms. If you do not agree to a change, stop using CarBluff and cancel any subscription.
12. Governing law
These terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in [STATE] will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there, to the extent permitted by law.
